STIPULATED RENTAL AGREEMENT FOR MARCH AND APRIL

 

Whereas, Jane Doe and John Doe, (hereinafter referred to as “Tenants”), filed a claim with the Residential Rent Stabilization & Arbitration Board on November 16, 2001  against the landlords, Mr. Black and Mr. White  (hereinafter referred to as “Landlords”), alleging “Failure to Provide Service” at 100 Post St. Apt, 1, San Francisco, California (hereinafter referred to as Apartment ).

 

Whereas, the Landlords filed or plan to file a claim in state court against Tenants for unlawful detainer for unpaid March 2002 rent, and 5% late fees for the months October 2001 through and including March 2002.

 

 

NOW, THEREFORE, IT IS HEREBY STIPULATED AND AGREED BY THE PARTIES HERETO:

 

1.         That repairs and remedies will be made to the Apartment  by the Landlords as of March 31, 2002, which are:

 

  1. Fix the sharp edges of the toilet bracket and stairs.

 

  1. Secure the loose banister of the stairs.

 

  1. Put tap-lights at the bottom of the stairs to dispel the darkness.

 

  1. Provide tenants with a two-month supply of batteries for use in the tap-lights.

 

  1. Fix the bathtub overflow so that it doesn’t spill on the floor.

 

  1. Remove the linoleum “water splash” and wallpaper in the bathroom.

 

  1. Extend the shower curtain rod around to the other side of the bathtub, next to the wall.

 

  1. Put up shower curtains in the bathroom.

 

  1. Fix both heaters.

 

  1. Provide a garbage can.

 

k.   Provide an area in which to store the garbage can.

2.         That the Landlords also stipulate and agree to:

 

  1. Reduce the rent for March and April from $1580 to $1000 per month

 

  1. Allow tenants to pay March rent on March 20, 2002 and April rent will be due on April 1, 2002.

 

  1. Relinquish any claim as to an unlawful detainer or 5% late fees for the months before March 2002, and withdraw any civil action filed in state court based on such claims.

 

  1. On May 4, 2002, upon inspection and finding the unit is in good condition, return the security deposit of $2000 in full.

 

  1. Or on May 4, 2002, after inspection return the security deposit of $2000, minus only deductions for repair of damage caused by the Tenants or their guests. .

 

3.         That Tenants stipulate and agree to:

 

  1. Withdraw their claim for failure to provide services with the Residential Rent Stabilization & Arbitration Board

 

  1. Pay March rent, $1,000, on March 20, 2002 and April rent, $1,000, on April 1, 2002.

 

  1. Pay a penalty of 5% for any rent paid late during March and April.

 

  1. Be present for Pre-inspection of the unit by the Landlords at 9:00AM, on

April 20, 2002.

 

e.   Repair any damage to the unit caused by the Tenants or guests of Tenants.

     

f.    Vacate the unit as of midnight April 30, 2002.

 

g.   Return the key to Mr. Black by 5:00PM, May 1, 2002 at his place of business:

  1. Be present for Inspection of the unit by the Landlords at 9:00AM, May 4, 2002.

 

  1. That any tenant not vacating the unit by April 30, 2002 is considered to be a hold-over and must pay a penalty of  $100 per day up to  and including the day of vacate.

5.         That the terms of this agreement are to be strictly construed as a compromise of a contested claim for the purposes of avoiding any further controversy, litigation and expense.

 

6.         That this agreement is entered into by the parties hereto in good faith and by accepting the terms of the agreement both parties have waived and relinquished any right to re-assert their claims.
